Terms and Conditions for Lumi

1. Provider and scope
The provider of the digital service Lumi is:

These Terms apply to consumers using Lumi. Lumi includes, in particular, the Lumi app, the web application and the backend and cloud services required to provide them.
2. Purpose and scope of Lumi
Lumi is a digital service for organising a private household. Depending on the selected plan and technical availability, Lumi may provide household and member management, calendars, tasks, shopping lists, recurring chores, pet features, documents, contracts, reminders, household mail, push notifications, document search and AI-assisted functions.
The specific scope of service is determined by the offer shown in Lumi or the App Store when a plan is purchased or changed. Features may be implemented differently across supported platforms.
Lumi is not an emergency, safety, legally compliant archive, legal, tax, financial, medical or veterinary advisory service.
3. Registration, accounts and minors
A user account is generally required. Authentication may be provided through Sign in with Apple. Users are responsible for appropriately securing their devices and Apple accounts.
Anyone purchasing a paid subscription or administering a household must have sufficient legal capacity under applicable law.
Children under the age of 14 may use Lumi with their own user account only with the consent of a parent or legal guardian. Parents or legal guardians are responsible for appropriately supervising such use and managing the access rights granted to the child.
A child profile created within a household is not, by itself, a separate Lumi user account.
4. Households, roles and invitations
Content is generally assigned to a household. One account may belong to more than one household. Roles may include administrators and residents.
Administrators may manage settings, members, people, invitations and subscription-related functions. Users are responsible for sharing invitations only with persons whom they intend to give access.
For technical access-control purposes, the provider may generally rely on the roles and memberships stored in Lumi. The provider is not required to resolve private disputes between household members concerning shared content unless required by law.
5. Subscriptions, prices and payment
Lumi may be offered in plans including Basic, Plus and AI. Price, billing period, features and any trial or introductory offer are shown immediately before purchase.
On Apple devices, digital subscriptions are processed through the Apple App Store. Apple handles payment. The applicable App Store terms apply in addition to these Terms for the App Store transaction.
Auto-renewable subscriptions renew in accordance with the conditions shown at purchase until auto-renewal is disabled through the Apple account's subscription management. Cancellation generally stops future renewal; access already paid for remains available until the end of the paid period, subject to mandatory law.
Paid features may be disabled following a refund, payment failure, chargeback, expiry or corresponding notice from the payment provider.
Upgrades and downgrades take effect as described in Lumi and the App Store. Following a downgrade, features may become unavailable; existing content is not necessarily deleted immediately.
6. Withdrawal, refunds and consumer rights
Mandatory withdrawal, cancellation, refund and conformity/warranty rights remain unaffected. For App Store transactions, the technical handling of refund requests is additionally subject to Apple's applicable process.
If paid contracts are offered directly by the provider in the future, all legally required pre-contract information will be provided separately before the contract is concluded.
7. Availability and maintenance
Lumi is an internet-based digital service. No specific percentage availability or service level is promised unless expressly agreed.
The provider may perform reasonable maintenance, security, update and repair measures. Technical interruptions may also occur outside planned maintenance.
Lumi is not designed for uses where uninterrupted availability is required to prevent danger, meet an irreversible deadline or avoid substantial loss. Mandatory statutory rights remain unaffected.
8. Microsoft Azure and other third-party services
To provide Lumi, the provider uses third-party technical services, including cloud, database, storage, authentication, push, payment, AI, search and API/interface services from Microsoft, Apple and, where applicable, other providers.
Lumi's production core may in particular be hosted on Microsoft Azure. Outages, maintenance or changes affecting that infrastructure may affect Lumi.
The provider is not liable for loss caused exclusively by circumstances outside its sphere of influence that could not have been prevented even with the care reasonably required in the circumstances, provided that neither the provider nor any person for whose conduct the provider is legally responsible is at fault.
This does not exclude any statutory attribution of fault of persons used by the provider to perform its own contractual obligations. Mandatory warranty/conformity and damages rights remain unaffected.
Optional integrations such as Outlook, Microsoft Graph or OneDrive also depend on the relevant third-party account, permissions, interfaces, quotas and terms.
9. Documents, contracts and reminders
Lumi may allow users to store documents and record contract details, terms, notice periods and reminders. These functions are organisational tools and do not constitute legal review.
Users remain responsible for independently checking and meeting legally, financially or personally important deadlines.
Reminders may be delayed or not delivered because of incorrect entries, device or operating-system settings, missing connectivity, disabled push permissions or technical failures.
OCR, search and AI functions may contain recognition errors. The original document remains authoritative. Lumi is not intended to be the sole or legally compliant archive for irreplaceable originals; important originals and necessary backups should be kept outside Lumi.
10. Lumi AI and automated functions
Where included in the selected plan, Lumi may provide an AI assistant. AI-generated outputs may be inaccurate, incomplete, ambiguous or outdated.
Where technically supported and initiated by a user action, the assistant may read household information and perform actions within Lumi, such as creating or modifying tasks, events, reminders or shopping-list items.
Users must review important AI outputs and actions. Legal, financial, medical, veterinary or safety-related decisions must not be based on AI output without appropriate independent verification. Lumi AI is not professional advice.
The provider may implement reasonable rate limits, abuse-prevention measures and safety boundaries, provided the agreed scope of service is not unlawfully restricted.
11. User content and necessary rights
Rights in content submitted by users generally remain with the respective rights holders. For the duration and purpose of providing Lumi, the user grants the provider the non-exclusive rights reasonably required to store, technically reproduce, transmit, process, secure and make content available to authorised household members.
Users may submit content and personal data relating to other persons only where they are entitled to do so.
12. Acceptable use
Lumi may only be used lawfully and for its intended private purpose. Prohibited conduct includes attacks on systems, circumvention of access or security controls, malware, abusive automated load and use of another person's account without permission.
Activities expressly permitted by mandatory law remain unaffected.
13. Restrictions and suspension
The provider may temporarily restrict access where there is an objective reason, including a concrete security risk, reasonable suspicion of abuse, a payment or subscription issue, a legal or regulatory obligation or a material breach of these Terms.
Measures will be limited to what is necessary and lifted when the reason no longer exists, provided the contract remains in force.
14. Term and termination
The term of a paid subscription is determined by the selected billing period. Auto-renewal of an Apple subscription may be stopped through Apple's subscription management.
The provider may stop offering renewals for future billing periods. Periods already paid for remain unaffected except where there is an important reason or mandatory law provides otherwise.
Immediate termination for cause remains possible, in particular in cases of serious or repeated abuse or intentional unlawful attacks. Where a prior warning is appropriate and reasonable, one will be given first.
15. Account and household deletion
A user account may be deleted using the provided function. Memberships are ended on deletion. If the deleted user was the last member of a household, the household and content controlled by Lumi may be deleted.
Deleting a Lumi account or household does not necessarily cancel an App Store subscription purchased through Apple. The subscription may also need to be cancelled through Apple's subscription management.
Mandatory retention, data-access and privacy rights remain unaffected.
16. Statutory conformity and warranty
Mandatory statutory rules applicable to digital services supplied to consumers apply. The provider owes the agreed functionality and characteristics of the selected plan and any updates required by law.
No additional voluntary guarantee is given unless it is expressly identified as such.
17. Changes to Lumi
Because Lumi is provided continuously, the provider may change the digital service beyond necessary updates where the legal requirements for doing so are met.
Valid reasons may include changes in law or regulatory requirements, security and privacy measures, technical developments, changes in supported operating systems or interfaces, changes or discontinuation of essential third-party services, bug fixes and measures to improve stability or scalability.
Changes made under this clause will not, merely by virtue of the change, create additional charges. Users will be informed clearly about relevant changes. Mandatory rights in the event of more than minor adverse impact remain unaffected.
18. Liability
The provider is liable in accordance with applicable law for death or personal injury and without limitation for damage caused intentionally or by gross negligence.
In cases of slight negligence, liability remains in particular where an essential core contractual obligation of Lumi is breached. This includes the agreed core features and, where included in the plan, storage and access control of household content owed by the provider.
To the extent permitted by law, liability for pure property or financial loss caused by slight negligence is excluded where only an ancillary obligation was breached and the limitation does not undermine the purpose of the contract.
The provider is not liable for loss caused by authorised household members acting within their technical permissions where there is no fault attributable to the provider.
Mandatory liability, conformity/warranty and consumer rights remain unaffected.
19. Privacy
Information on the processing of personal data is provided in Lumi's separate Privacy Policy.
20. Changes to these Terms
The provider may amend these Terms where there is an objective reason and the contractual balance is not unfairly shifted to the user's detriment. Reasons may include changes in mandatory law, higher-court case law, regulatory requirements or the service itself.
Where consent is legally required, it will be obtained separately. Silence will be treated as consent only where this is legally permissible in the specific circumstances and all requirements are met.
21. Governing law and jurisdiction
Austrian law applies. For consumers, this choice of law does not deprive them of the protection of mandatory provisions of the country of their habitual residence where those provisions apply under conflict-of-law rules.
Statutory consumer jurisdiction rules apply.
22. Language versions
The German version is the reference version of the Lumi Terms. Translations are provided for convenience and accessibility. In the event of a discrepancy, the German version prevails to the extent permitted by the mandatory consumer law applicable to the user. This does not restrict mandatory consumer rights.
23. Final provisions and contact
If any provision is wholly or partly invalid, the remaining provisions remain unaffected and the applicable statutory rule takes its place.
